Contractual Capacity and Eligibility
Legal Age Requirement: To purchase an AGNESTOTH 1/1 edition creation or commission a bespoke item via this website, you must be at least 18 years of age and possess the full legal capacity to enter into binding contracts.
Consumer Sales Only: Products sold on this website are intended strictly for private, personal, and non-commercial use. We reserve the absolute right to refuse or cancel orders that we suspect are intended for unauthorized resale, commercial distribution, or competitive replication.
Pricing Currency and Finality
Transaction Currency: All transactions are processed in the currency specified at checkout (typically EUR or USD depending on your geographic location). AGNESTOTH is not responsible for any international transaction fees, conversion discrepancies, or banking charges applied by your financial institution.
Price Inclusions: Prices listed dynamically at checkout include European Union VAT where applicable, alongside the pre-calculated customs duties and import taxes collected via our Delivery Duty Paid (DDP) system for international destinations.
Force Majeure & Fulfillment Limitations
Exclusion of Liability: AGNESTOTH is dedicated to meeting all estimated delivery schedules. However, we shall not be held liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Conditions of Sale that is caused by a Force Majeure Event (acts of God, global supply chain disruptions, severe weather, strikes, or customs clearance backlogs).
Remedy for Non-Fulfillment: If a Force Majeure event prevents the completion of a standard 1/1 order, our studio will contact you immediately, and our liability will be strictly limited to providing a full refund of any funds already paid.
GLOBAL BLUE TAX-FREE POLICY
In-Store Exclusivity Only: Tax-Free shopping validation via Global Blue is strictly available for eligible non-EU residents who make a physical purchase in person at our authorized physical retail studio/shop.
Online Sales Exclusion: In accordance with standard international tax frameworks and Global Blue regulatory terms, Tax-Free Forms cannot be issued or processed for remote online purchases delivered directly to an address via e-commerce (agnestoth.com). For online orders bound for international destinations, cross-border duties and taxes are managed exclusively via our integrated checkout calculations (as detailed in Section 2).
Client Bureaucratic Liability: For authorized in-store purchases, the AGNESTOTH shop staff will issue the initial Global Blue Tax-Free Form during checkout. However, it is the sole responsibility and legal liability of the client to correctly process all subsequent paperwork.
Customs Stamping Requirement: To qualify for any VAT refund, the client must independently present their completed Tax-Free Form, original physical passport, purchase receipts, and unused goods to EU Customs or an official validation kiosk at their final point of departure from the European Union to obtain the mandatory customs stamp.
Exclusion of Brand Liability: AGNESTOTH (MARVELOSA Kft.) acts solely as an issuing merchant. We hold no liability, operational obligation, or financial responsibility regarding denied refunds, processing delays by Global Blue, or a client's failure to secure the required validation stamps before leaving the EU.
4. Shipping & Delivery
4.1 Shipping Rates and Delivery Timelines
Complimentary Delivery: AGNESTOTH provides complimentary Express Shipping globally for all orders including insurance with DHL Express.
Standard Delivery Windows: Once your order is processed, standard delivery timelines are generally as follows:
- Hungary and the European Union: Within 3 business days.
- International Destinations: Within 6 business days.
All online orders are dispatched within 24 hours from Wed-Fri.
Orders placed on Weekends or on Mon-Tue will be dispatched the following working day.
Processing Buffers: Orders paid via credit card or digital wallets are processed immediately, though fulfillment may be subject to standard security and fraud validation procedures. For any orders completed via bank transfer, delivery timelines will be calculated from the date full payment confirmation is received by our studio
6. Returns, Right of Withdrawal & Bespoke Products
6.1 Statutory Right of Withdrawal — Distance & Off-Premises Purchases
Right of Withdrawal: Where a consumer purchases an eligible AGNESTOTH product through our website or otherwise concludes a distance or off-premises contract, the consumer has the statutory right to withdraw from the contract without giving a reason within 14 calendar days from the day on which the consumer, or a third party nominated by the consumer other than the carrier, receives the product. This statutory right of withdrawal does not apply to purchases concluded at the AGNESTOTH Atelier.
Returns Process: To exercise the right of withdrawal, the consumer must notify AGNESTOTH of the decision to withdraw before expiry of the withdrawal period by an unequivocal statement sent to contact@agnestoth.com. Following notification of withdrawal, the product must be returned without undue delay and no later than 14 days after the consumer communicates the decision to withdraw.
6.2 Condition of Withdrawal Products
Usage Limitations: The statutory right of withdrawal permits a consumer to inspect and handle a product only to the extent necessary to establish its nature, characteristics and functioning. Usage beyond this purpose will render the bag used and disqualify it from the right of withdrawal.
Consumer Responsibilities: The consumer is responsible for any diminished value resulting from handling beyond what is necessary for that purpose. AGNESTOTH products are individual luxury pieces supplied with presentation materials and accessories. When assessing any diminished value, AGNESTOTH may take into account the condition of the product and, where relevant, its accompanying straps, accessories, certificates, presentation case, dust bag, protective materials and other components supplied with the product.
Evidence of Material Reduction of Value: Wearing or using a product beyond what is reasonably necessary to inspect it may cause a material reduction in its value. Evidence of such use may include, without limitation, wear, marks, staining, odour, damage, alteration, contamination or other deterioration occurring after delivery.
Deductions from Refunds: Where legally permitted, AGNESTOTH reserves the right to deduct from the amount refunded an amount corresponding to the objectively established diminished value resulting from handling beyond that necessary to establish the nature, characteristics and functioning of the product. Because the products are unique in nature, images online of the bag in use diminishes its resale value completely, so used bags do not qualify for the right of withdrawal.
6.3 Return Shipping
Return Shipping Liability: Where a consumer exercises the statutory right of withdrawal for reasons unrelated to a defect or lack of conformity, the consumer shall bear the direct cost of returning the product to AGNESTOTH, inclusive of shipping, insurance and any applicable duties, provided that the consumer was informed of this obligation before concluding the purchase.
Shipping Requirements: Given the value and unique nature of AGNESTOTH products, customers are required to return products using a secure, tracked and appropriately insured delivery service and to retain proof of dispatch until the return has been completed.
Reimbursements: AGNESTOTH may withhold reimbursement until the returned product has been received by AGNESTOTH and the condition of the product assessed as being returned in a saleable condition.
6.4 Refunds Following Statutory Withdrawal
Refund Schedule: Where a valid statutory right of withdrawal is exercised, AGNESTOTH will reimburse payments as required by applicable by law. Refunds will normally be made using the same means of payment used for the original transaction unless otherwise expressly agreed. Refunds will be processed within 48 hours of saleable condition assessment, because of variations in payment method, weekend and public holiday schedule, AGNESTOTH cannot guarantee when these payments will be received.
Refund Deductions: AGNESTOTH reserves the right to account for any legally recoverable diminished value in accordance with Section 6.2 above.
6.5 Exclusion from the Statutory Change-of-Mind Right
Exclusion Criteria: The statutory 14-day right of withdrawal does not apply where goods are made to the consumer's specifications or are clearly personalised. This includes AGNESTOTH bespoke commissions created specifically to a client's instructions, including individually commissioned colours, materials, embroidery, artwork, personalisation or other specifications that make the piece specifically created for that client. Where this statutory exception applies, the customer cannot cancel or return the product merely because they have changed their mind.
Commencement of Bespoke Production: For bespoke commissions, the order documentation will identify the specifications agreed with the client and any applicable deposit, production and cancellation arrangements. Once production has commenced, cancellation rights, if any, will be governed by the bespoke order agreement and applicable law.
Statutory Rights: The customer's statutory rights in respect of defective, damaged or non-conforming goods remain unaffected, but these should be handled through our warranty procedure, not the right of withdrawal.
6.6 Artisanal Variation
Variation Definitions: Each AGNESTOTH creation is individually produced and may incorporate artisanal processes and materials whose appearance naturally varies. Variations in colour, texture, grain, embroidery, stitching, painted edges, surface characteristics, dimensions or other artisanal details may occur between individual pieces.
Exclusion from Warranty: Such variations are not in themselves defects where they are inherent in the materials or production process, are consistent with the product description and samples or images provided. They do not prevent the product from conforming to the contract and therefore exclude the product from warranty criteria.
6.7 Pre-Dispatch Condition Records
Condition Record: Every AGNESTOTH product is inspected before dispatch. AGNESTOTH may create dated photographic and/or video records documenting the product, accessories, presentation packaging and shipping package immediately before dispatch.
Record Retention: These records may be retained as evidence of the condition of the product at the time of dispatch and may be considered when investigating a return, transit-damage claim, chargeback, alleged defect or other dispute.
6.8 Inspection of Returned Products
Returns Inspection: All returned products are inspected by AGNESTOTH following receipt. AGNESTOTH may compare a returned product with its pre-dispatch condition records and other relevant evidence in determining whether:
- the product has suffered diminished value following delivery
- damage appears consistent with transit damage
- a claimed issue constitutes a manufacturing defect or lack of conformity
- the condition results from normal characteristics of the materials or artisanal production process; or
- damage or deterioration occurred following delivery as a result of use, accident, improper handling, alteration or other external cause.
6.9 Returns Showing Evidence of Use or Alteration
Compensation for Diminished Value: AGNESTOTH takes the protection of its clients and the integrity of its one-of-one products seriously. Where a product returned under the statutory change-of-mind right shows evidence of handling or use beyond what is necessary to establish its nature, characteristics and functioning, AGNESTOTH may seek compensation for the resulting diminished value to the extent permitted by law.
Fraudulent Conduct: Where AGNESTOTH reasonably believes that a return, defect allegation or other claim involves deliberate misrepresentation, concealment, substitution, alteration or other fraudulent conduct, AGNESTOTH reserves all rights and remedies available under applicable law. The consumer will be liable for all legal fees incurred by AGNESTOTH in exercising all rights and remedies under applicable law.
Consumer Rights: Nothing in this section permits AGNESTOTH to refuse or reduce a refund merely because a customer has legitimately inspected a product or exercised a statutory consumer right.
6.10 Transit Damage
Responsibility for Damage: Where delivery is arranged by AGNESTOTH, responsibility for loss of or damage to the product during delivery remains with AGNESTOTH until risk passes to the consumer in accordance with applicable law.
Notification of Damage: Customers are requested to notify AGNESTOTH promptly of visible transit damage and to retain the product, shipping carton, packaging and all associated materials while the matter is investigated. Any claim by AGNESTOTH against DHL or another carrier or insurer is separate from, and does not reduce, the consumer's statutory rights against AGNESTOTH.
6.11 Mandatory Consumer Rights
Policy Overview: This policy shall be interpreted in accordance with applicable Hungarian law and mandatory European Union consumer protection law. No provision of this policy is intended to exclude, waive or restrict any consumer right or remedy that cannot lawfully be excluded, waived or restricted.
Contradictions of Provisions: Where any provision of this policy conflicts with a mandatory provision of applicable consumer law, the mandatory provision shall apply.
8. Product Repair Policy
8.1 Complimentary Warranty Repairs (Manufacturing Defects)
Warranty Period: AGNESTOTH provides a two (2) year complimentary repair warranty starting from the date of formal order delivery. This warranty strictly covers manufacturing defects or unexpected structural failures under normal, intended use conditions.
Verification Requirement: Before any warranty repair is approved, our studio will evaluate the item against the photographic and video records captured prior to its original shipment (as detailed in Section 6.8).
Exclusions from Warranty: This complimentary service does not cover damage resulting from accidental drops, improper storage, environmental exposure, chemical spills, customer alterations, or general negligence (such as those outlined in Section 7, the Embroidery Care Guide).
8.2 Out-of-Warranty & Wear-and-Tear Repairs
Lifetime Structural Support: Beyond our two-year manufacturing warranty, AGNESTOTH remains committed to the lifespan of your 1/1 creation. We offer lifetime repair assessments for structural issues resulting from long-term wear and tear (e.g., edge paint wear, hardware replacement, or lining adjustments).
Artisan Service Fees: For all out-of-warranty or customer-induced damage claims, the repair process is subject to service fees. These fees are calculated based on the cost of replacement luxury raw materials and the specialized artisan hours required by our Budapest Atelier.
8.3 Logistics, Shipping, and Insurance Procedures
Initiating a Repair Intake: To request a repair evaluation, you must contact our dedicated care team at restoration@agnestoth.com. Please provide your original Order Number, proof of purchase, and detailed, high-resolution photographs of the area requiring attention.
Pre-Authorization Requirement: No packages will be accepted at our Budapest studio without an official Repair Authorization Number issued by our team via email. Unsolicited shipments will be rejected and returned to the sender.
Shipping & Logistics for Repairs: To initiate an evaluation, clients must first submit detailed imagery to our digital care portal. Once our atelier pre-validates a potential warranty claim, AGNESTOTH will provide a complimentary, fully insured prepaid shipping label to bring the piece to our Budapest studio. If the physical inspection confirms a manufacturing defect, the repair and return shipping are entirely complimentary. If the inspection reveals the issue was caused by external factors or wear-and-tear, the client will receive a restoration quote and will be billed for the two-way transit costs.
For valid warranty claims: AGNESTOTH will completely repair the item free of charge if the issue is structural and will cover the cost of shipping the repaired piece safely back home to you.
For Out-of-Warranty / Fee-Based Repairs: The client is solely responsible for arranging and paying for insured, two-way transit via DHL, including all applicable cross-border customs duties and import clearance taxes.
Outside of one year warranty: the client will be provided a repair quote, and all two-way shipping costs and customs fees will remain the sole responsibility of the client.
Transit Risks: Because every AGNESTOTH handbag is an irreplaceable 1/1 work of art, all shipping for repairs must be fully insured for the item’s original retail value. AGNESTOTH cannot be held liable for any loss, theft, or damage that occurs to the product while in transit to or from our workshop.

Limited License: AGNESTOTH grants you a limited, non-exclusive, non-transferable, and revocable license to access and make personal use of agnestoth.com.
Prohibited Activities: You are strictly prohibited from using the site or its content to:
Engage in any unlawful, fraudulent, or malicious activities.
Transmit viruses, malware, worms, or any code of a destructive nature.
Extract data using spiders, robots, data mining, or extraction tools.
Attempt to bypass, disable, or interfere with the security features and encryption systems of our online boutique.
Account Security and Maintenance
Client Responsibility: If you choose to create a personal client profile on our website to track your orders, you are entirely responsible for maintaining the confidentiality of your account credentials and password.
Breach Notification: You agree to accept responsibility for all activities that occur under your account. If you suspect unauthorized access or a security breach, you must notify our team immediately at contact@agnestoth.com
Governing Law and Jurisdiction
Applicable Legal Framework: These Terms of Use, Conditions of Sale, and all contractual relations between you and the brand are governed exclusively by and construed in accordance with the laws of Hungary, without giving effect to any principles of conflicts of law.
Dispute Resolution: In the event of an unresolved dispute arising from your use of this site or a purchase, the matter shall be submitted to the exclusive jurisdiction of the competent courts of Budapest, Hungary. Alternatively, EU residents may access the European Commission's Online Dispute Resolution (ODR) platform for consumer complaints.
Copyright & Intellectual Property Policy
Ownership of Fine Art and Digital Assets
Exclusive Proprietary Rights: The website agnestoth.com and all its underlying elements—including, but not limited to, the name AGNESTOTH, the corporate identifier MARVELOSA Kft., custom logos, visual interfaces, website design, text layout, specific code, graphics, and digital assets—are the exclusive intellectual property of the brand and are protected by Hungarian, European Union, and international copyright and trademark laws.
Studio Photography & Videography: All campaign imagery, editorial lookbooks, behind-the-scenes video content, and high-resolution product photography captured within our Budapest atelier are strictly proprietary. Unauthorized downloading, altering, distributing, hotlinking, or commercial use of our media asset files is strictly prohibited.
Strict Protection Against Design Duplication & Counterfeiting
Artistic 1/1 Exclusivity: Every AGNESTOTH creation, layout pattern, and custom embroidery sequence is an original, legally protected work of fine art.
Prohibition of Replicas: We enforce a zero-tolerance policy against intellectual property theft. You are strictly prohibited from copying, adapting, reverse-engineering, modifying, or creating derivative works based on our 1/1 handbag structures, material applications, or artisan embroidery techniques. Any attempt to manufacture, distribute, market, or sell counterfeit replicas or look-alike designs that infringe upon our unique artistic patterns will be pursued to the maximum extent of the law.
Limited Personal License
Permitted Digital Use: Users are granted a limited, personal, and non-commercial license to access the site and share public editorial content solely via social media, provided that full, unedited credit is visually attributed directly to AGNESTOTH.
Prohibited Commercial Use: No portion of this website or our artistic assets may be reproduced, duplicated, sold, resold, or exploited for any commercial purpose without explicit, prior written authorization signed directly by the legal executives of MARVELOSA Kft.
Legal Enforcement & Remedies
Civil and Criminal Liability: Any unauthorized use of our trademarks, design patterns, or copyrighted materials constitutes a material breach of these Terms and a direct violation of international intellectual property law.
Enforcement Actions: MARVELOSA Kft. actively monitors global e-commerce marketplaces and digital platforms. In the event of an intellectual property violation, we will immediately issue Digital Millennium Copyright Act (DMCA) takedown notices, initiate formal legal cease-and-desist orders, and seek full financial damages, punitive remedies, and recovery of legal fees through the competent courts of Budapest, Hungary.
Bespoke & Multi-Year Commission Policy
Contractual Formation & Onboarding Process
Mandatory Signed Contract: To preserve the absolute integrity of our creative process, no bespoke service or custom 1/1 commission will commence without a formal, bilateral agreement. Prior to the initiation of any artisan studio work, all aesthetic details, material specifications, dimensions, and estimated production timelines will be thoroughly discussed, meticulously documented, and formally signed as a legally binding contract by both the artist Agnes Toth representing AGNESTOTH (MARVELOSA Kft.) and the client.
Upfront Payment Requirement: Due to the extreme exclusivity and specialized sourcing required for our rare materials, all bespoke orders must be paid in full upfront at checkout or via bank transfer prior to production. No workshop hours will be allocated, and no raw materials will be cut, embroidered, or reserved until full payment has cleared into our accounts.
Bespoke Communication & Abandonment
Active Client Contact: For high-end creations requiring extended production timelines (including unique pieces requiring intensive hand-stitched embroidery spanning approximately 2 years), the client is strictly required to maintain updated, active, and accessible contact information with our studio via bespoke@agnestoth.com
Fulfillment Notification: Upon the final physical completion of your commissioned creation, our studio will issue an official "Ready for Shipment" notification to your registered email address.
Forfeiture Timelines: If a client fails to provide a verified shipping address, respond to our studio correspondence, or fulfill any outstanding contractual logistics within ninety (90) calendar days of our initial completion notice, the order will be legally deemed abandoned.
Retention of Ownership: In the event of abandonment, the upfront payment made to date will be permanently retained by MARVELOSA Kft. as liquidated damages for materials and specialized artisan hours, and AGNESTOTH will retain absolute ownership and unrestricted global resale rights of the unique 1/1 piece.
Prohibition of Mid-Transit Address Redirection
Locked Checkout Delivery: Due to the extreme rarity, high-value status, and specialized transit insurance protocols applied to AGNESTOTH 1/1 parcels, all shipments are securely locked to the exact physical delivery address authorized and verified at checkout.
Courier Restrictions: Clients are strictly prohibited from modifying the shipping address or using independent courier management portals (such as DHL On Demand Delivery) to reroute, redirect, or hold packages at third-party pick-up points mid-transit.
Voiding of Insurance: Any unauthorized alteration to the pre-approved delivery path made independently by the client completely voids our transit insurance coverage. In such cases, full legal liability for any resulting loss, theft, interception, or physical damage shifts instantly and entirely to the client.
Price Adjustments for Multi-Year Contracts
Locked Configurations: The upfront price finalized and paid at the contract's signing covers the exact design specifications and raw material costs projected at the time the order was placed.
Material and Modification Fluctuations: Because multi-year hand-stitched commissions span approximately 2 years, they are uniquely exposed to long-term market realities. AGNESTOTH reserves the right to adjust the final remaining balance prior to dispatch if:
The client requests structural or aesthetic design alterations after the signed contract has been executed and production has already commenced.
Extreme, unforeseen global market events cause unprecedented spikes in the acquisition costs of our rare, sustainable luxury raw materials (such as our certified apple-leather substrates or precious metal hardware components).
Prior Consultation: Any necessary adjustments will be fully detailed, documented, and discussed transparently with the client before the final stages of artisan assembly are completed.

Single-Colour Pieces: The single coloured embroideries are the only pieces we repeat, but each colour is repeated only every other year. Which means they may reach an edition of 50 over 50 years.
